Pennsylvania Confirms Landscape Architects Qualified for Stormwater
State agency reverses previous statement that limited most stormwater practice to engineers.



On January 17, the Pennsylvania Department of Environmental Protection issued a letter reversing its earlier position regarding the qualifications of landscape architects to address stormwater management. The letter confirms that landscape architects "are qualified to design certain structural stormwater best management practices (BMPs)."

In late 2006, the Pennsylvania Department of Environmental Protection (DEP) adopted new stormwater management provisions, including BMPs such as vegetated swales, biofilters, and the like. Along with the regulations, DEP held a series of training sessions through which the department informed attendees that the new stormwater management plans can only be sealed by an engineer, including these BMPs that are clearly within the scope of landscape architecture (and identified in the definition of landscape architecture in the licensing law).

Upon identification of this situation, the Pennsylvania/Delaware ASLA Chapter contacted DEP to voice its concern regarding this restriction of landscape architecture practice. The February 27, 2007, reply from the DEP acknowledged the “capacity” of landscape architects to perform some stormwater management, but it still left much unclear. The chapter and the Pennsylvania State Board of Landscape Architects worked together to clarify the scope of practice of landscape architects. The board sent DEP a letter, then followed up with a listing of the structural BMPs that indicated whether each project type is within the scope of practice of landscape architecture.

The combined effort of PA/DE ASLA and the state licensing board provided the DEP with the information necessary to reverse its previous policy. The ASLA Licensure Committee is currently working to develop a tool kit of resources for chapters and individual landscape architects who face similar barriers to practice at the state and local level. Chapters are encouraged to contact Government Affairs Director Julia Lent when facing similar barriers where they practice the profession.

芦屋市六麓荘の建築条例/敷地面積４００平方メートル以上

　兵庫県芦屋市では、「建築物の制限に関する条例改正案」が審議され12月22日の市議会で可決した。 　この条例では六麓荘町は、400平方メートル未満の土地の売買、高さ10メートル以上の建物の新築の禁止、そして敷地面積400平方メートル以上の一戸建て住宅しか新築できなくなる。2007年2月から施行予定。 【関連記事】 芦屋“金満”条例成立、４００平方ｍ以上に一戸建て 新建築：市条例で「豪邸」限定へ　兵庫・芦屋の高級住宅街 　六麓荘町は昭和初期に大阪の財界人らが開発し、当初から景観に配慮するため電線の地中化など先進的なまちづくりを進めていた。また、建築協定（紳士協定）で、条例同様の敷地規模、壁面後退、緑化などが定められていた。 　しかし、相続などで敷地の細分化や老人ホーム建設など協定に反する事業が計画されたため、地域住民が０４年１２月にまちづくり協議会を結成し、誌に条例づくりを働きかけていた。 参考情報： 美しい景観利用のための土地利用

クルドサック/ラドバーン方式

　今朝の新聞で都内のクルドサックが紹介されていた。クルドサック（フランス語：cul-de-sac）は袋小路とは異なり、自動車が方向転換できる様にサークル上になっている。通過交通の抑制などメリットも多く、歩行者専用道と組み合わせ、利便性を高めているケースもよくみられる。自分もまちづくりの提案に盛り込んだことがあるが、メリットは評価されたもののその場所では消防の関係で実現が難しかった。 さて、このクルドサックに独立した歩行者専用道を組み合わせた歩車分離の代表的なシステムとしてラドバーン方式がある。この方式はニュージャージー州ラドバーン地区で1920年代に実現し、日本のニュータウン開発にも大きな影響を与えたといわれている。モータリゼーション到来を予測して計画されたこの住宅地開発は、各住戸と学校、商店、公園が緑豊かな歩行者専用道で結ばれている。（写真は左と中がクルドサック、右が住戸を結ぶ緑道）      　 このまちにはコモンスペース（共有地）の管理を目的として設立されたラドバーン協会（Radburn association）がある。この協会は固定資産税の一定額を納付することにより運営されており、コモンスペース（ハード）管理だけでなく、レクリエーションや環境教育などさまざまなプログラム（ソフト）を提供している。周辺の住宅地が一部スラム化する中で、このまちは高級住宅地ブランドが維持されており、結果として地価も上昇を続けている。 　日本においてもラドバーン方式を参考にした開発事業がいくつか見られるが、好事例として評価されている（成功した）事例は少ないように思う。ハードをコピーするだけでなく、適切なソフトサービスの仕組みを検討していかないと、高級住宅地となることは難しいのだろう。
